This website is owned and operated by Daily Pharma (“we”, “us”, “our”), located at 167-Readymoney Terrace, Block B, 1st Floor, Dr. Annie Besant Road, Worli Naka, Mumbai- 400018, India. References to “you” or “your” mean any person who accesses or uses the website at https://dailypharma.in/ (the “Site”) or places an order with us.

1. Acceptance of these terms

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood and agree to be bound by these Terms & Conditions, together with our Shipping Policy, Returns & Refunds Policy and Privacy Policy, each of which forms part of these terms. If you do not agree, please do not use the Site. These terms constitute an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require any physical or digital signature.

2. Definitions

  • “Products” means the daily pharmaceutical, nutraceutical, wellness, and health supplement products offered for sale on the Site.

  • “Order” means a request submitted by you to purchase Products.

  • “Order Confirmation” means our email or message confirming that we have accepted your Order.

  • “Content” means all text, images, video, graphics, logos, product names and other material on the Site.

3. Eligibility & your account

You must be at least 18 years of age and capable of forming a legally binding contract under the Indian Contract Act, 1872, to purchase from us. If you are below 18, you may use the Site only under the supervision of a parent or legal guardian who agrees to these terms on your behalf.

You may need to create an account to place an Order. You are responsible for keeping your login details confidential and for all activity under your account. Please give us accurate, current and complete information, and keep it updated. We may suspend or close any account that we reasonably believe has been used in breach of these terms.

4. Products & pricing

Our Products are daily wellness, nutraceutical, and pharmaceutical formulations intended to support health. Each Product page describes the Product, its usage, dosage instructions, and ingredients.

  • Product Representation: We try to display product packaging, sizes, and descriptions as accurately as possible. However, actual packaging or minor batch visual variations may occur and do not constitute a defect.

  • Pricing: All prices are listed in Indian Rupees (INR) and are the Maximum Retail Price (MRP), inclusive of applicable Goods and Services Tax (GST), unless stated otherwise. Shipping charges, where applicable, are shown at checkout before you pay.

We may change prices, run offers, or revise Product descriptions at any time without prior notice. The price that applies to your Order is the price shown at the time you place it. Despite our best efforts, a Product may occasionally be mispriced or its details may contain an error. If we discover an error in the price or description of a Product you have ordered, we will contact you and may cancel the Order and refund any amount paid.

5. Orders & acceptance

Your Order is an offer to buy the Products. All Orders are subject to acceptance by us. A contract is formed only when we send you an Order Confirmation or dispatch the Products — not when you receive an automated acknowledgement of payment. We may decline or cancel any Order, in whole or in part, including where:

  • the Product is out of stock or no longer available;

  • there is an error in the price or description of the Product;

  • we are unable to deliver to the address provided;

  • we suspect the Order is fraudulent, made by an unauthorized reseller, or placed in breach of these terms; or

  • quantity limits per customer or per Order apply.

If we cancel an Order for which you have already paid, we will refund the amount paid using the original payment method.

6. Payments

We accept the payment methods shown at checkout, which may include credit and debit cards, UPI, net banking, wallets and, where available, Cash on Delivery. Payments are processed through secure third-party payment gateways. We do not store your full card or banking details.

You confirm that the payment details you provide are valid and belong to you. Your payment is also subject to the terms of the relevant payment provider. Where Cash on Delivery is offered, an additional handling fee will be displayed at checkout.

7. Shipping & delivery

We ship in line with our Shipping Policy, which sets out delivery areas, processing times, charges, temperature-control requirements, and estimated timelines. Delivery timelines are estimates and are not guaranteed. Risk in the Products passes to you on delivery to the address you provide.

8. Cancellations, returns & refunds

Because our Products are daily pharmaceutical and health supplements, returns are strictly limited for hygiene, temperature integrity, and safety reasons. Your rights to cancel, return and obtain a refund are set out in full in our Returns & Refunds Policy, which forms part of these terms. Nothing in these terms limits the rights available to you as a consumer under the Consumer Protection Act, 2019.

9. Health product use, disclaimers & safety

Our Products are daily pharmaceutical, health supplement, and wellness products intended for personal use and to be used strictly as directed on the packaging and Product page.

  • Not Medical Advice: Content on this Site is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician or healthcare provider before starting any new daily supplement or healthcare regime.

  • Usage & Allergies: Read all ingredient lists, warnings, dosage instructions, and directions carefully before consumption or use.

  • Adverse Reactions: If you experience any adverse reactions, discontinue use immediately and consult a medical professional.

  • Storage: Products must be stored under conditions specified on the label (e.g., cool, dry place, or refrigerated) to maintain safety and efficacy. Keep out of reach of children.

You are responsible for using the Products appropriately. Individual health outcomes and results may vary.

10. Intellectual property

All Content on the Site, including the Daily Pharma name, logo, product formulations names, photography, copy, design and layout, is owned by or licensed to Daily Pharma and is protected by Indian and international intellectual property laws.

You may view and use the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify or exploit any Content, or use any of our trademarks, without our prior written consent.

11. Reviews & user content

You may be able to submit reviews, ratings, or other content. By submitting content, you confirm it is your own, is accurate, and does not infringe anyone’s rights or any law. You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce and adapt that content across our marketing and channels, with attribution where reasonable.

We may moderate, edit or remove any user content at our discretion, and we are not responsible for content submitted by users. Please do not post anything unlawful, misleading, health-misleading, abusive, or that contains personal data of others.

12. Acceptable use

When using the Site, you agree not to:

  • use the Site for any unlawful, fraudulent or harmful purpose;

  • resell our Products without authorization, or place bulk Orders for unauthorized distribution;

  • attempt to gain unauthorized access to, interfere with, or disrupt the Site or its security;

  • use any bot, scraper or automated means to access or copy the Site or its data; or

  • infringe our or any third party’s intellectual property or other rights.

13. Third-party links & services

The Site uses third-party services such as payment gateways, logistics and courier partners, analytics and marketing tools, and may link to third-party websites. We are not responsible for the content, products, services or privacy practices of those third parties. Your dealings with them are governed by their own terms. Where our Products are listed on third-party marketplaces, the terms of that marketplace apply to those purchases in addition to ours.

14. Disclaimers

The Site and the Content are provided on an “as is” and “as available” basis. To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error-free or secure, or that the Content is complete, accurate or current. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law, including your statutory rights as a consumer.

15. Limitation of liability

To the maximum extent permitted by law, Daily Pharma, its directors, employees and partners will not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of the Site or any Product. Subject to the paragraph above and to your statutory consumer rights, our total liability to you in connection with any Order will not exceed the amount you paid for the Products giving rise to the claim.

16. Indemnity

You agree to indemnify and hold harmless Daily Pharma and its team from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Site, or your violation of any law or third-party right.

17. Privacy

We process your personal data in accordance with our Privacy Policy and applicable Indian data protection law. By using the Site, you consent to that processing.

18. Force majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, extreme weather, strikes, transport or courier disruption, power or internet failures, pandemics, government action, or acts of war or terrorism.

19. Governing law & jurisdiction

These terms are governed by and construed in accordance with the laws of India. Subject to the grievance and consumer-protection mechanisms available to you, the courts at Mumbai, Maharashtra will have exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of the Site.

20. Grievance redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, the Drugs and Cosmetics Act (where applicable), and the Information Technology Act, 2000, you may raise any complaint with our Grievance Officer, whose details are below. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt.
